(1)指示;要求 例如在票据法上,支票就是由出票人向银行发出的支付一定金额给持票人的一项指示。 (2)(大陆法)授权书 指被代理人向代理人所作的书面指示或命令,亦即「power of attorney」。 (3)(大陆法)〈苏格兰〉无偿寄托 指一方当事人无偿地为他人实施行为或管理事务而形成的合同。通常由寄托人〔mandator〕请求受托人〔mandatary〕无偿为其提供服务,若其同意则合同成立并生效。但除非受托人已经实施行为,否则不承担责任。受托人须根据指示行事,并以一个谨慎的人处理自己的事务那样尽到注意和预见的义务,而寄托人对于受托人在行为过程中所造成的损失应予补偿。它与「寄存」〔deposit〕不同,后者的主要目的是针对物,当事人的行为或劳务则是附属的;前者主要针对人的行为,物则是附属的。它源于罗马法的「mandatum」,并多用于大陆法与苏格兰法中。 (4)(国际法)委任统治 指在第一次世界大战后由国际联盟〔League of Nations〕授权某些国家对某些地区的行政及发展行使权力的一种制度,是为托管〔trusteeship〕制度的前身。 (5)命令;指示 上诉法院要求下级法院采取指定措施的命令。 (6)执行令 指示法院官员执行某一法院命令或裁定的司法命令。
