fealty n. (1)(臣民对国王的)忠诚;忠实;效忠 (2)(封建法)效忠宣誓 由封建土地保有人对其领主宣誓保证效忠于领主,是对宗教性忠诚的保证,宣誓时由宣誓人置右手于一本《圣经》或其他圣物之上。效忠义务包括:不伤害领主身体、不损害其名誉、不损坏其财产、便利领主行善。不同于人身依附性的臣服宣誓〔homage〕,后者是对土地保有权的承认,产生封建主与其封臣〔vassal〕或佃户之间庇护与忠诚服从的权利义务关系,但它并不能超越于对君主的效忠。而前者是必不可少的封建权利义务关系,只产生于土地保有人与其直接领主〔immediate lord〕之间。它包括缴纳租金及其它财产性封建义务等内容。效忠宣誓也指公簿地产保有人〔copyhold tenant〕对领主在租约期间内的附带义务,即宣誓在租约期内忠实履行封建义务。(=fealte; fidelitas; feaulte)(→allegiance; homage; service; subtraction)
