possessory interdict

An interdict that protected a person whose possession was disturbed without due process.

• A possessor in bad faith could obtain a possessory interdict because the interdict did not depend on title. It would, however, establish whether the possessor would be the defendant or the plaintiff in any subsequent claim. See INTERDICTUM. [Cases: Injunction 39. C.J.S. Injunctions § 68.]
