Intellectual property. An agreement by two or more persons to commit an act that would interfere with the exclusive rights of a patent, copyright, or trademark owner.

• This action is commonly recognized in trademark law. The Copyright Act does not provide a basis for alleging a conspiracy to infringe, but an action is recognized by some states. The Patent Act provides no basis for an action asserting conspiracy to infringe because patent law covers only acts, not threats of acts.
