A legacy that depends on an uncertain event and thus has not vested.

• An example is a legacy given to one’s granddaughter “if she attains the age of 21.” [Cases: Wills 628–638. C.J.S. Wills §§ 1320–1379, 1551.]

contingent legacy 不确定的遗赠；期待性遗赠 指取决于某些未定事件而发生效力的遗赠。当时间作为遗赠条件时，如果仅仅是支付时间〔time of payment〕的推迟，那么这种遗赠就不是这里所说的不确定的〔contingent〕，而是确定的〔vested〕；如果时间和遗赠物之实质连在一起，作为一个先决条件，那么它就是不确定的。具体区分要看语句之表达，如：「到甲21岁时给他」〔to be paid or payable to A when he shall attain 21〕意味着该遗赠是确定的，如果省去paid, payable而说the legacy is…
