contingent legacy 不确定的遗赠;期待性遗赠 指取决于某些未定事件而发生效力的遗赠。当时间作为遗赠条件时,如果仅仅是支付时间〔time of payment〕的推迟,那么这种遗赠就不是这里所说的不确定的〔contingent〕,而是确定的〔vested〕;如果时间和遗赠物之实质连在一起,作为一个先决条件,那么它就是不确定的。具体区分要看语句之表达,如:「到甲21岁时给他」〔to be paid or payable to A when he shall attain 21〕意味着该遗赠是确定的,如果省去paid, payable而说the legacy is to A on attaining 21,则为不确定的遗赠。还有解释说只有涉及到土地遗赠(不包括土地利益之赠与)才可以被解释为是不确定的。动产与不动产混合遗赠的要优先适用动产解释,即要理解为是确定的。 (→contingent bequest)
