implied warranty

An obligation imposed by the law when there has been no representation or promise; esp., a warranty arising by operation of law because of the circumstances of a sale, rather than by the seller’s express promise. [Cases: Contracts 205.15; Sales 262.5. C.J.S. Contracts § 359; Sales § 252.]
