Geneva Convention on the High Seas 《日内瓦公海公约》 1958年8月23日于日内瓦举行的第一次海洋法会议上签订，1962年9月30日生效。该公约确认自19世纪以来即已被接受为国际法准则的海洋自由原则。公约确定公海为除国家的领水或国内水域外的全球所有水域。根据公约的规定，任何国家不得对公海的任何部分主张主权。各国在公海享有航行、捕鱼、铺设海底电缆和管道以及飞越公海的同等权利。公约并未解决不同国籍的船舶在公海上碰撞的管辖权问题。对船员的刑事或纪律程序只能由船旗国或被告人的所属国管辖。
