life peerage 〈英〉 (1)终身贵族;非世袭贵族 (2)终身贵族爵位;非世袭贵族爵位 19世纪以前,贵族大多是世袭的,非世袭的终身贵族为数不多,由国王以公开发表的特许状〔letters patent〕授予男爵〔baron〕爵位,以终身享有为限,并不得出席上议院,无投票权,甚至不发给议会召入令〔writ of summons to Parliament〕。1856年,为加强上议院的司法功能,财税法庭法官詹姆斯·帕克爵士〔Sir James Parke〕被封为终身贵族,但上议院特权委员会仍认为帕克不能担任议员和投票,其后他才被授予世袭爵位。1876年,《上诉管辖权法》〔Appellate Jurisdiction Act〕授权增封4名终身贵族作为常任上诉法官〔Lords of Appeal in Ordinary〕,协助履行上议院的司法职能。1958年,《终身贵族法》〔Life Peerages Act〕为终身贵族的增封作出一般规定,授予男爵爵位,同时取消妇女不能担任上议院议员的限制。从此时起,事实上新增封的贵族都是终身贵族。终身贵族终身享有收受议会召入令的权利,退休后继续享有。
