partial failure of consideration

A party’s incomplete performance of a contract with multiple, severable performances, so that if some of the performances are not accomplished, the appropriate part of the agreement can be apportioned to whatever has been completed. [Cases: Contracts 86, 260. C.J.S. Contracts §§ 84, 133, 135, 466.]
