〈美〉迁徙权 长期以来一直受宪法保护的一项权利，其典型例证是在某州没有居住满一定期限者，有权申请该州的福利支助，在美国认为剥夺公民的此项权利，就是剥夺其迁徙权，因而也剥夺了其法律平等保护权〔equal protection of the law〕。虽然，美国宪法并没有具体规定该项权利，但早在19世纪60年代，美国最高法院宣布宪法第四条中的特权和豁免权条款〔Privileges and Immunities Clause〕保证每个人都有跨州来往的权利。在新近的几个案例中，最高法院也再次遵循了州际迁徙原则，坚持州无权为迁徙设置障碍的原则。
