abuse of process (1)滥用诉讼程序 指恶意地不正当地使用常规的诉讼程序，以期从对方当事人处获得某种利益。如原告通过欺诈诱使被告进入法院辖区，以便可以向其送达令状，则法院可以滥用诉讼程序为根据撤销送达。 (2)滥用传票 指不正当地使用法院合法签发的传票以期获得某种非法的或超出传票范围之外的后果。与恶意控告〔malicious prosecution〕不同，后者指为不正当的目的且无合理根据而提起民事或刑事诉讼，原告可恶意地使传票被签发。而滥用传票则指对合法签发的传票的滥用。
