competence n. (1)(证人的)作证资格;作证能力 指证人能否在法院审判或其他司法调查程序中作证的能力或资格。法律一般都对证人的条件有所规定,如呆傻人不能作证人。证人是否适格,由法院决定。 (2)证据资格;(证据的)可采性 指依证据能否被法庭采纳来对案件的某一问题予以证明。 (3)资格;能力 在合同法中,指当事人达到法定年龄,且有行为能力,无精神残疾的状况。 (4)权限;管辖权 指法院等裁判机关处理特定事务或立法机关就某些事项制定法律或规则的权力。有时与jurisdiction同义 。(→competency)
