constructive trust 推定信托 指法律根据当事人的某些行为以及衡平原则而推定产生的信托关系，以阻止不法行为人从其不法获得的财产上不当得利。如违反他人意愿或滥用其信任，以实际或推定的欺诈、胁迫或各种违法、不公正、阴谋、隐瞒手段获得在公平和诚信情况下本不应该获得并享有的权利。法律推定此类行为违反信托关系。
