damnum fatale 〈拉〉(罗马法)意外损害 即不可避免的意外损害,指因人力不可控制的原因,如闪电、海难等造成的损害,财产的受寄托人〔bailee〕及其他人都无需对此承担法律责任。在后来的普通法中,往往用「天灾或公害」〔Act of God or public enemies〕来加以概括,但罗马法中的意外损害还包含了一些现在已不认为是不可抗力〔irresistable force〕因素所造成的损害。意外损害不包括因盗窃所致损害。 (→act of God)
