desuetude n. 废弃;不用 该词可用以指一种学说,该学说认为,如果一部法律或一项条约久未实施或适用并达到足够的时间,则即使其并没有被废除,法院也不再认为其具有法律效力。这种「不用可以废止法律」原则的适用极为有限且须谨慎为之。罗马法和古苏格兰及国际法中都承认这一原则。英格兰并不承认这项原则,英格兰法不会仅因为长久不用而失效,其废止需明令废除,但也可用新法废止旧法的方式进行。
