diplomatic protection 外交保护 外国人在其居留国因该国对之实施违反国际法的行为受到人身或财产损害时，该外国人的本国要求居留国予以适当救济，即为外交保护。外交保护是一种国家行为，外交保护权属于国家主权权利的范畴，行使与否由国家自行裁定，不论受害者是否向本国提出请求。一国享有对居留他国的本国人给予外交保护的权利，但须符合两项原则或条件：一是国籍继续原则，即受害者自受害之时至受到外交保护的期间，须持续保有其本国国籍；二是用尽当地救济原则，即受害者已在居留国采取一切可供采取的救济手段，仍未得到合理救济。
