discussion. 1. The act of exchanging views on something; a debate. 2. Civil law. A creditor’s act of exhausting all remedies against the principal debtor before proceeding against the guarantor. discussion n. (1)讨论；商讨 (2)先诉；(保证人的)先诉抗辩(权) 指债权人在对保证人追索之前，应当先行对主债务人用尽所有救济。保证人所享有的权利即为先诉抗辩权〔benefit of discussion〕。这种做法源于罗马法，目前主要见于大陆法系。在苏格兰法中，这种特权于1865年被取消，但当事人可以明示方式约定授予该项权利。
