divortium 〈拉〉(罗马法)协议离婚；两愿离婚 指夫妻不经法院判决而自行解除婚姻关系的行为。《十二铜表法》〔Twelve Tables〕规定丈夫有权休妻，自无夫权婚姻风行后，夫妻即可因双方合意而离婚。优士丁尼受基督教影响，对离婚自由加以限制。因不符合罗马的传统习惯，故优帝二世(公元565-578年)接位后即恢复离婚自由。
