Dombrowski doctrine

Dombrowski doctrine 〈美〉多姆布罗斯基原则 此原则源出美国最高法院1965年「多姆布罗斯基诉菲斯特」〔Dombrowski v. Pfister〕一案。美国最高法院在该案中认为原告有权获得禁制令〔injunction〕以阻止州官员根据一项其规定非常模糊而又笼统因而与美国宪法第一条修正案所赋予的权利相牴触的州法律,对原告起诉或威胁要对原告起诉。该案判决后,联邦法院接到数以百计的案件,其中诉讼者援此原则主张权益,至今该原则之实际意义及其适用尚未确定。
