emphyteusis 〈拉〉(罗马法) (1)永久租赁契约 根据这种契约，土地出租人将土地长期或永久性地租给承租人，用于耕种或建造房屋或作其他用途，只保留每年收取租金的权利；承租人并有权将该土地转让给他人或由其继承人继承，且只要他逐年交纳了租金，出租人即不得撤销契约或要求重新订约或要求收回土地。 (2)永租权 依永久租赁契约而享有的上述永佃权及地上权。
