executory devise 将来生效的不动产遗赠 指不动产遗赠的生效取决于将来某一事件的发生。因此,该事件的发生与否决定着该项不动产的将来归属,且在此之前,任何人都无权转让该项不动产。如果受遗赠人在该事件发生前死亡,则该项不动产由在该事件发生时该受遗赠人的继承人继承,而不是由该受遗赠人死亡时的继承人继承。在英格兰,此种不动产遗赠受到衡平法以及1535年《用益法》〔Statute of Uses〕和1540年《遗嘱法》〔Statute of Wills〕的承认;早期的普通法有一项确定的原则,即遗赠的不动产如果没有明确的限制,只能由受遗赠人在其生存期间保有,而将来生效的不动产遗赠与此原则相背,因而是无效的;后来则承认在有遗嘱的情况下可作为例外。
