Falcidian law

Falcidian law (罗马法)《法尔西地亚法》 根据保民官法尔西地亚〔Falcidius〕的提议,于罗马714年(即公元前40年)奥古斯都统治时期制定的关于遗嘱处分的法律。根据该法,立遗嘱人通过遗嘱处分遗产的权利受到重大限制。即遗嘱所作出的遗赠不得超过遗产的3/4,至少应为继承人保留1/4的遗产份额,即法尔西地亚份额〔Falcidian portion〕。如有违反,继承人有权于必要时按比例扣减各受遗赠人所得的遗赠。
