fiducia 〈拉〉(罗马法)信托 抵押〔mortgage〕和质押〔pledge〕的一种早期形式。指财产所有权和占有权以正式的买卖方式——如要式买卖〔mancipatio〕——转移给债权人，同时附有明示或默示的协议，规定当债务及时得到清偿时，债权人应将财产以相同的买卖方式返还；如债务人违约，则该项财产将不附带任何赎回权，完全归于债权人。
