Fourth Amendment

Fourth Amendment 美国宪法第四条修正案 修正案保证人们的人身安全及财产免遭非法搜查和扣押。修正案还规定,无合理根据不得发布搜查令和扣押令,而且只能对指定的地点进行搜查,只能对指定的人和物品予以扣押。在美国早期历史上该修正案只适用于联邦政府,至1868年第十四条修正案通过后,通过第十四条修正案中的正当法律程序条款,该修正案的适用范围才被扩展到州。它确立了美国公民一项不受政府官员和代理人不正当入侵威胁的绝对权利。 (→probable cause; search)
