habitatio 〈拉〉(罗马法)居住权 人役权的一种。指有居住他人房屋的权利。其效力范围较用益权〔jus fruendi〕窄，而较使用权〔jus utendi〕宽。按习俗，此项权利以受益人的终身为限，但不因不行使或人格变更而消灭。优士丁尼规定居住权可以出租，在此之前，罗马法学家对能否出租是有争议的。 (→habitation)
