heir presumptive
An heir who will inherit if the potential intestate dies immediately, but who may be excluded if another, more closely related heir is born. — Also termed presumptive heir. Cf. heir apparent. [Cases: Descent and Distribution 68. C.J.S. Descent and Distribution § 68.]
