holograph n. 亲笔文件;亲笔契据;亲笔遗嘱;自书遗嘱 指全部或基本部分由当事人亲笔书写的文据或遗嘱。在苏格兰,此种遗嘱即使没有证人签名也被认为是有效的;在美国,各州法律对这种亲笔遗嘱的规定不一,有些州基于遗嘱须由见证人签名的要求,不承认无证人签名的亲笔遗嘱,有些州则予以承认。美国《统一遗嘱检验法》〔Uniform Probate Code〕第2-503条规定,如果遗嘱签名及实质条款是由立遗嘱人亲笔所写,则无论是否有证人见证,该遗嘱均属有效。该法为部分州所采纳。
