King’s peace 〈英〉国王和平;公共秩序 在中世纪早期的英国法中,特殊的个人或团体,如国王、教会都有自己的和平秩序,针对这种和平所发生的违法行为均被视为是破坏该种和平的行为,并因此要遭受处罚。11世纪时国王和平是地方性和个人性的,限于特定时间段和地域,并随国王的去世而灭失,故在老国王去世之后和新国王登基以前这一段时间内所发生的违法行为不被视为是破坏国王和平,也不受处罚,尽管他有可能是破坏了某一个贵族的和平。爱德华一世〔Edward Ⅰ〕继承王位后,他立即公布了他的和平秩序——这在日后成为了惯例。后来,国王和平不断扩展,直至覆盖了整个英格兰每时每刻,这样,任何违反国王和平者都难逃惩罚。国王力图扩大「破坏国王和平」这一概念的范围,意在增加自己的收入,因为被告人往往因其破坏国王和平的行为要遭受巨额罚金,这些行为后被列入刑事诉讼〔pleas of the Crown〕范畴之内。
