lex talionis 〈拉〉同态报复法 即以眼还眼、以牙还牙的治罪方法,最早存在于《旧约全书》〔Old Testament〕问世时代。在古罗马,根据《十二铜表法》〔Twelve Tables〕,对严重的身体伤害可以实行这种报复。任何文明国家似乎都未确立过这种法律原则。英国《1363年法令》〔Act of 1363〕规定,任何向国王顾问会议请求报复的建议应提供担保,但这种惩罚方式1年后被废止。在现代国际法中,该术语体现了如下的原则:一国可以同样的方式报复带给本国公民伤害的外国公民。 (→retaliation)
