military jurisdiction 〈美〉军事管辖 在美国宪法中有三种军事管辖:第一种适用于平时与战时;第二种适用于发生在国外的对外战争或在为叛乱者所占领的地区内发生叛乱或内战时;第三种适用于外国入侵或在仍拥护联邦政府的州内发生叛乱时。第一种情况被称为依据军事法行使管辖权〔jurisdiction under military law〕,一般见于国会的有关战争的规定及允许武装力量执政的法律中;第二种情况被称为军事管制政府的管辖〔jurisdiction under military governments〕,由军队司令官根据总统指令和在国会明示或默示同意下行使职责;第三种情况被称为军事管制法下的管辖〔jurisdiction under martial law〕,由国会决定,但如果国会不能作出决定而且形势需要时,可由总统决定。
