mutuum 〈拉〉消费借贷(合同) １在罗马法上，是指一种借贷，其中借方有权消费借得的物品，然后按同等数量返还给贷方。消费借贷合同和使用借贷合同〔commodatum〕、租赁合同〔locatio conductio〕一起，构成了许可他人用益某物的三种合同形式；２指一种交易形式——有时称之为寄托，其中所交付的物并不返还原物，而是以返还同种类的其他物来代替。正因为不返还特定的原物本身，所以在普通法上不认为其是寄托，而以之为买卖或交换。
