mutuum 〈拉〉消费借贷(合同) 1在罗马法上,是指一种借贷,其中借方有权消费借得的物品,然后按同等数量返还给贷方。消费借贷合同和使用借贷合同〔commodatum〕、租赁合同〔locatio conductio〕一起,构成了许可他人用益某物的三种合同形式;2指一种交易形式——有时称之为寄托,其中所交付的物并不返还原物,而是以返还同种类的其他物来代替。正因为不返还特定的原物本身,所以在普通法上不认为其是寄托,而以之为买卖或交换。
