new trial 重新审判 指在判决作出后对判决中所裁决的部分或全部争议重新进行审理。初审法院可依当事人的申请命令对案件重审，也可以主动决定重审。上诉审法院在推翻初审法院判决的情况下也可以将案件发回初审法院，要求对其中的部分或全部争议重新进行审理。
