nexum

nexum 〈拉〉(罗马法)债务口约;要式契约 拉丁文nexum是拘束、债的意思。在早期罗马法中,该词仅指「要式现金借贷」,这种契约和要式买卖都采用铜块和衡器的形式,且当事人需采用法定语言,其效力在于对未按期还债的债务人可施以苦役、出卖或杀戮等残酷处罚。后来随着现金借贷逐渐适用于所有可计量物的借贷,nexum也成为普通的消费借贷契约。广义上,它指契约当事人之间的债务关系,有时可以与obligatio互换。公元前326年《柏德尔法》〔Lex Poetilia〕废除之。
