payee n. 受款人;收款人 受款人应当具有合理的确定性。依照英国1882年《汇票法》〔Bills of Exchange Act〕的规定,汇票、本票或支票可以指定一人为受款人,也可以指定若干人为共同受款人,或者指定若干人中的一人或几人均得为受款人,或指定现任某一职务者为受款人;但当受款人为虚构的〔fictitious〕或不存在〔nonexisting〕之人时,可凭票付款〔payable to bearer〕。美国《统一商法典》〔Uniform Commercial Code〕规定,票据的受款人足可视为票据的正当持票人〔a payee may be a holder in due course〕;换言之,如无相反证明,应视受款人为正当持票人。 (→fictitious payee)
