Roman law 罗马法 广义上,指在罗马人中普遍适用的所有法律,而不论其形成的时期,包括优士丁尼大全〔collections of Justinian〕。较狭义的罗马法,如德国的用法,仅指优士丁尼的法律。在英国与美国,习惯使用「罗马法」一词,区别于「大陆法」〔civil law〕,以表示包括优士丁尼大全在内的罗马法体系。「罗马法」与「大陆法」的区别在于,「大陆法」是指以优士丁尼大全的基本概念和原则为基础发展起来的欧洲大陆国家的法律,而罗马法是指从罗马国家建立到帝国衰亡整个时期发展而成的罗马法体系。(→civil law; civil law systems)
