stipulatio 〈拉〉(罗马法)要式口约 一种口头合同,要求双方当事人用特定的语言经过问、答相符而订立。承诺方即回答者须依约行事,不必有任何对价,发问方也不负任何责任,所以是一种单务合同。在要式口约中,最关键的是双方当事人必须亲自一问一答,回答的内容必须与发问两相符合,且回答须旨在由此承担合同义务。要式口约是罗马法中要式合同的形式之一。 (→actio ex stipulatu)
