substitution of parties 当事人的替换在诉讼中由于一方当事人的死亡、丧失行为能力、利害关系〔interest〕的转移或作为一方当事人的公职人员死亡或离职等原因而由他人代替该当事人继续进行诉讼。在严格意义上，替换后的当事人是在同一诉讼中取代原当事人的地位，而非依另一不同的诉因起诉或被诉。
