transferred intent doctrine (刑法)转移故意理论在犯罪故意的驱使下所作出的非法但无故意的行为，依然被认定为故意犯罪行为；即犯罪人最初的犯罪故意从意图被害人转移到实际被害人身上。例如犯罪人企图谋杀甲，却因错误或疏忽而杀害了乙，此时犯罪人仍应被认为犯有故意谋杀罪。在侵权行为法上亦然，如果侵权人企图对某人实施侵权行为，但实际上使第三人受损，则该第三人得以故意侵权而要求行为人承担责任，尽管其对第三人并无侵权故意。
