breve testatum 〈拉〉书面备忘录 用以使土地转让证书和封地册封长久保存的书面备忘录。
testatum n. 〈美〉 (1)协助执行令;第二次执行令 指由一县的法院在被告人不在本县境内时,向本州内被告人或其财产所在的另一县的行政司法官发出的令状。如法院已对案件作出判决,并签发了拘留还债令〔ca.sa.〕后,行政司法官在执行回呈中说明被告人不在本县境内,这时,法院即可发出协助执行拘禁令〔testatum ca.sa.〕,要求被告人所在另一县的行政司法官将被告人拘禁或扣押其财产。 (2)连署证明条款;证明条款 指财产转让契据中的连署证明条款。

ground writ (英格兰古法)裁判地令状 1852年《普通法诉讼程序法》〔Common Law Procedure Act〕颁布前适用的一种令状,在法院向案件审判地以外的其他郡签发拘留还债令〔capias ad satisfaciendum〕或债务人财产扣押令〔fieri facias〕之前,必须先向本郡签发裁判地令状,然后再向有关他郡签发异地执行令状〔testatum writ〕。
