marshalling assets 决定债务人财产的清偿次序 其原则是,当两个以上债权人要求就债务人财产进行清偿时,对债务人部分财产有抵押权的债权人应受到保护,但应尽可能照顾其他债权人的利益。如第一债权人可以就债务人的两笔财产取得清偿,而第二债权人只能就债务人的一笔财产取得清偿,则公平原则要求第一债权人首先就第二债权人所不能求偿的那笔债务人财产取得清偿,而不是取走第二债权人唯一能求偿的那笔财产,从而避免第二债权人的债权落空。例如,债务人甲有两项财产A、B,债权人乙先在A、B上设定抵押,债权人丙在B上设定抵押,则乙在实现债权时应当先执行A,而不能先执行B,以免丙的抵押权不能实现。也称「marshalling securities」、「marshalling liens」或「marshalling remedies」。 (→rule of marshaling assets)
