mandatory statute 强制性制定法；强行法 指必须遵守，法院无自由裁量权，涉及实体问题或影响实体权利的制定法；这种法律规定应该作为而不仅是可以作为，其特征为法律用语常使用「应」〔shall〕而非「可」、「得」〔may〕。
