waiver of tort 侵权之诉的放弃；放弃侵权之诉 某人受到侵权从而享有选择救济方式之权利，若其选择以准合同起诉，要求被告返还不当得利，而替代以侵权行为提起诉讼，要求获得损害赔偿的，则被称为对侵权之诉的放弃。但是，在此情况下，侵权之诉并未消灭。实际上，这两种救济方式是「无之则不然」〔sine qua non〕的关系，原告均应证明侵权行为之存在。
